Terms of Service

1. What HeyWisho provides

HeyWisho helps you create personal greetings using selected characters, your words, writing assistance and card designs. Previews include 12 Higgsfield Studio preset portraits and 6 custom portrait models. The interface identifies available products, supported languages and whether checkout is live or a test. Video orders use manual production by our team; you review the finished result before sharing. Recipient email delivery is not currently available. Test payments do not purchase a live product.

An illustration or layout preview is not a promise that a voice or video is available. A paid offer, when enabled, must identify the actual product, supported language, price and delivery conditions before you order.

2. Age and accounts

You must be at least 18 and legally able to enter a contract to create an account or place an order. The creation service is intended for adults. Keep your sign-in email secure and provide accurate account and order information. If acting for another person or a business, you must have authority to do so.

3. Your words and other people's information

You are responsible for the names, messages, personal stories and other material you submit. Provide only information you are entitled to use and share. Obtain permissions required for another person's image, voice, personal information or protected material; do not assume the service grants those rights. When enabled, the optional €0.99 photo add-on lets you upload a private reference for a comic character in a manually produced video. You must confirm that you have the necessary permission and consent. The original photo is not published or added to the prebuilt avatar catalog. Voice cloning is not offered.

Keep greetings proportionate and respectful. Do not include passwords, payment details, medical records or other highly sensitive information. Include information about children only where lawful and appropriately authorized.

4. Acceptable use

Do not use HeyWisho for unlawful content, sexual exploitation, sexualized depictions of minors, non-consensual intimate material, threats, hate, harassment, doxxing, fraud, deceptive impersonation or infringement of other people's rights. Flirty greetings require an adult recipient; a playful roast must not become abuse.

Do not attack the service, evade access controls, automate abusive requests or redistribute its technology or character assets without permission. We may restrict unlawful or abusive activity, giving an explanation where appropriate and legally permitted.

5. AI suggestions and your review

The companion offers writing assistance, not professional advice. Suggestions may be inaccurate, unsuitable, similar to other outputs or culturally insensitive. Review names, facts, pronunciation, tone and the full greeting before approval or sharing. You decide what to use; the assistant cannot authorize a purchase or delivery for you.

A demo response may be produced from templates. An external AI provider is used only when that feature is enabled. We do not guarantee exclusive outputs, copyright protection for purely AI-generated elements, or ownership of third-party rights.

6. Content rights and character artwork

You keep any rights you hold in your submitted material. You permit us and the service providers needed for your request to process, store, render and transmit that material to operate, secure and deliver the greeting. This permission does not authorize unrelated advertising with your private greeting.

HeyWisho's software, branding and supplied character artwork remain ours or our licensors'. Unless a product expressly grants broader rights, you may use supplied artwork as part of your personal greeting, not resell the character assets, extract them as a stock library or imply endorsement by a real person. Your use of a finished result remains subject to third-party rights and applicable law.

7. Orders and payments

HeyWisho's greeting products are individual purchases, not automatically renewing subscriptions. Displayed demo prices are proposals. Once sales are enabled, the checkout must show the charge, currency, applicable taxes and product before you confirm. Do not assume a price in euros is a price in US dollars.

Stripe processes enabled card payments on its checkout. We do not receive your full card number. Payment and production relate to the specific version you approve; later edits do not automatically change an existing order. Your browser's return from checkout alone is not proof of successful payment.

8. Cancellations, problems and refunds

Contact us promptly if you need to cancel or an ordered greeting is missing, defective or materially different from its description. The available remedy depends on whether production or delivery has occurred and on applicable law; correction, replacement or a refund may be appropriate. There is no blanket exclusion of refunds for digital or personalized products.

Mandatory withdrawal, cancellation and conformity rights remain intact. Where early supply of digital content requires an express request, consent and acknowledgement about a withdrawal right, those must be obtained separately before supply; accepting these terms alone does not waive that right.

9. Gift links and delivery

Review the recipient, greeting and delivery details before releasing a gift. Anyone who obtains a working gift link may open it; it is not protected by checking the recipient's identity. Share links carefully. Revocation stops new access but cannot erase copies already downloaded or immediately invalidate every previously issued short-lived media link.

Delivery dates and availability depend on the product actually offered. Scheduled email and generated video are not active in the current demo. A browser-only envelope preview is not a public gift link. Keep your own copy of any result you want to preserve.

10. Availability, restrictions and changes

We may maintain or change the service and restrict access for security or serious misuse. We will respect existing paid obligations and mandatory rights. You may stop using the service and contact us about your account. Clearing a browser draft does not delete all cloud or order records.

Material changes to these terms will be identified with an updated date and communicated as required. Changes do not retroactively remove rights attached to an existing purchase; any legally required renewed agreement will be requested.

11. Warranties and liability

To the extent permitted by law, the service is provided as available without a promise of uninterrupted operation, error-free AI output or suitability for every purpose. This does not exclude an express product commitment or mandatory consumer guarantee.

Where law allows, we exclude indirect or consequential losses and limit aggregate liability arising from the service to the greater of US$100 or the fees you paid us in the three months before the event. These exclusions and limits do not apply where prohibited, including to fraud, intentional misconduct, gross negligence, or death or personal injury caused by negligence where liability cannot be limited.

12. Wyoming law and dispute resolution

The law of the State of Wyoming, USA governs these terms, excluding its conflict-of-law rules. Subject to mandatory law, disputes may be brought before the competent state or federal courts in Wyoming. If you are a consumer, this choice does not remove non-waivable protections or rights to bring proceedings in your place of residence. Applicable privacy laws also continue to apply. These terms do not impose mandatory arbitration or a class-action waiver.

For a copyright or privacy complaint, identify the affected material or link, explain your rights and provide a way to contact you. Do not send unnecessary sensitive information. We review complaints under applicable law.
